(1) BEER TO WHICH COLORING MATTER OR PORTERINE HAS BEEN
ADDED REPRESENTING THE BEER TO BE MALT EXTRACT OR PORTER OR ANOTHER
BEVERAGE; OR (2) ANY MALT OR LIQUOR OTHER THAN BY ITS PROPER NAME.
(C) PENALTY A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 1 YEAR OR A FINE
NOT EXCEEDING $500 OR BOTH. REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also added this section, which is new language derived without
substantive change from former Art. 27, § 159. In subsection (b) of this section, the former reference to a "corporation or
officer thereof" is deleted as included in the comprehensive reference to a
"person". See Art. 1, § 15. Similarly, in subsection (c) of this section, the
former reference to a "corporation or officer or agent thereof" is deleted as
included in the comprehensive reference to a "person". In subsection (b)(2) of this section, the reference to a "liquor" is substituted
for the former archaic reference to a "spiritous liquor" for style. In subsection (c) of this section, the former phrase "in the discretion of the
court having jurisdiction" is deleted as implicit in the establishment of
maximum penalties. The Criminal Law Article Review Committee notes, for the consideration
of the General Assembly, that in subsection (b)(2) of this section, the
references to "malt" and "liquor", revising the former references to "malt"
and "spiritous liquor", do not include "wine", which is defined as a
fermented beverage in § l-102(a)(28) of this article. Defined terms: "Beer" § 1-102
"Person" § 1-102 Article 24 - Political Subdivisions - Miscellaneous Provisions 11-509. (E) DOGS IN HEAT IN CERTAIN COUNTIES — EXCLUDED. THIS SECTION DOES NOT APPLY TO A VIOLATION OF § 11-512, § 11-513, OR §
11-514 OF THIS SUBTITLE. REVISOR'S NOTE: Chapter 26, Acts of 2002, which enacted the Criminal Law
Article, also added this subsection to provide that §§ 11-512 through
11-514 of this subtitle, which are derived from former Art. 27, §§ 70
through 70B, are not subject to the general penalty provided in this
section.
