Ch. 26 2002 LAWS OF MARYLAND
(2) EACH ORGANIZATION THAT RECEIVES A PERMIT FOR A FUNDRAISER
UNDER THIS PART SHALL DESIGNATE AN INDIVIDUAL WHO IS RESPONSIBLE FOR
COMPLYING WITH THE TERMS AND CONDITIONS OF THE PERMIT AND THIS PART. (B) LOCATION. AN ORGANIZATION THAT RECEIVES A PERMIT FOR A FUNDRAISER UNDER THIS
PART SHALL CONDUCT THE FUNDRAISER IN: (1) A STRUCTURE THAT IS OWNED, LEASED, OR. OCCUPIED BY THE
ORGANIZATION; (2) A STRUCTURE THAT IS OWNED, LEASED, OR OCCUPIED BY AN
ORGANIZATION THAT WOULD QUALIFY FOR A PERMIT UNDER § 13-2621 OF THIS
SUBTITLE; OR (3) A PUBLIC LOCATION THAT IS DESCRIBED IN THE PERMIT
APPLICATION AND APPROVED BY THE STATE'S ATTORNEY FOR THE COUNTY. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 251B(e) and (i). In subsection (a)(1)(i) of this section, and the introductory language of
subsection (b) of this section, the references to a permit "for the fundraiser"
are added for clarity. In subsection (a)(2) of this section, the reference to each organization "that
receives a permit for a fundraiser under this part" is added for clarity. Also in the introductory language of subsection (b) of this section, the
reference to an organization that "receives" a permit is substituted for the
former reference to an organization that "is issued" a permit for
consistency within this section. In subsection (b)(1) of this section, the former reference to the organization
"receiving the permit" is deleted in light of the reference in the
introductory language of subsection (b) to "[a]n organization that receives
a permit". Defined term: "Person" § 1-101 13-2627. ACCOUNTING. WITHIN 30 DAYS AFTER A FUNDRAISER CONDUCTED UNDER THIS PART, THE
ORGANIZATION THAT RECEIVED THE PERMIT FOR THE FUNDRAISER SHALL SUBMIT
TO THE COUNTY. COMMISSIONERS: (1) AN ACCOUNTING OF ALL FUNDS RECEIVED OR PLEDGED; (2) AN ACCOUNTING OF ALL EXPENSES PAID OR INCURRED; AND (3) A STATEMENT UNDER OATH OF THE APPLICATION OF THE NET PROFITS.
