Ch. 26 2002 LAWS OF MARYLAND
(C) TIME LIMIT. A MULTIPLE GAMING DEVICE PERMIT ISSUED UNDER THIS PART IS VALID FOR
ONLY ONE FUNDRAISER LASTING NOT MORE THAN 6 HOURS. (D) OCEAN CITY. THE COUNTY COMMISSIONERS MAY NOT ISSUE A MULTIPLE GAMING DEVICE
PERMIT FOR USE IN OCEAN CITY OR ON REAL PROPERTY THAT IS OWNED BY OCEAN
CITY AND LOCATED IN THE COUNTY. (E) CLASS B OR D ALCOHOLIC BEVERAGES LICENSED PREMISES. THE COUNTY COMMISSIONERS MAY NOT ISSUE A MULTIPLE GAMING DEVICE
PERMIT TO HOLD A FUNDRAISER ON PREMISES THAT ARE LICENSED UNDER A CLASS
B OR CLASS D ALCOHOLIC BEVERAGES LICENSE. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 25lB(c), (d), (g), and (h). Subsections (b), (d), and (e) of this section are revised in the active voice to
clarify that it is the county commissioners who are prohibited from issuing
multiple gaming device permits under certain circumstances. In subsection (b)(1) and (2) of this section, the references to multiple
gaming device permits "for fundraisers" are added for clarity. In subsection (c) of this section, the reference to a fundraiser lasting "not
more than" 6 hours is added for clarity and accuracy. Also in subsection (c) of this section, the reference to a "fundraiser" is
substituted for the former reference to an "event" for consistency with the
terminology used throughout this part. Also in subsection (c) of this section, the former reference to a multiple
gaming device permit issued "for a fund-raiser at which 2 or more gaming
devices will be used" is deleted in light of the use of the defined term
"multiple gaming device permit". In subsection (d) of this section, the reference to use "on" real property is
substituted for the former reference to use "within the boundaries of" real
property for brevity. Also in subsection (d) of this section, the former reference to use in "the
corporate limits of" Ocean City is deleted as surplusage. In subsection (e) of this section, the prohibition against "issu[ing]" a
multiple gaming device permit is substituted for the former prohibition
against "approv[ing]" a multiple gaming device permit for consistency with
the terminology used throughout this part.
