10-408.

(a) (1) Each application for an order authorizing the interception of a wire,
oral, or electronic communication shall be made in writing upon oath or affirmation to
a judge of competent jurisdiction and shall state the applicant's authority to make the
application. Each application shall include the following information:

(ii) A full and complete statement of the facts and circumstances
relied upon by the applicant, to justify his belief that an order should be issued,
including:

10-4A-04.

(a) (1) An investigative or law enforcement officer may require a provider of
wire or electronic communication service to disclose the contents of wire or electronic
communication that is in electronic storage in a wire or electronic communications
system for 180 days or less, only in accordance with a search warrant issued by a
court of competent jurisdiction.
