A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 60 DAYS OR A FINE
OF NOT LESS THAN $100 AND NOT EXCEEDING $500 OR BOTH.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 96 1/2, § 42.

In subsection (b)(1) of this section, the reference to the "Air Force" is added.
See General Revisor's Note to title.

In subsection (b)(2) of this section, the former reference to the "naval
militia" is deleted as obsolete. There is no longer a naval militia in
Maryland. See Ch. 638, Acts of 1.999.

In subsection (b)(3) of this section, the reference to the "Maryland Defense
Force" is substituted for the former reference to the "State guard" for
accuracy. See § 2, Ch. 239, Acts of 1990, which provides that "with regard to
any existing regulation, policy, or document created by any official agency
or unit of the State, the term 'Maryland State Guard' and every variation
of that term means 'Maryland Defense Force'".

In subsection (c) of this section, the phrase "on conviction" is added for
clarity.

13-902. SALE, PURCHASE, OR IMPROPER USE OF PROPERTY; UNLAWFUL WEARING
OF UNIFORM.

(A)     SCOPE OF SECTION.

THIS SECTION DOES NOT APPLY TO A MEMBER OF THE UNITED STATES ARMY,
NAVY, AIR FORCE, MARINES, OR COAST GUARD, THE ORGANIZED MILITIA OF THIS
STATE OR ANOTHER STATE, AN OFFICER OF THE MARYLAND DEFENSE FORCE, OR A
MEMBER OF ASSOCIATIONS WHOLLY COMPOSED OF SOLDIERS HONORABLY
DISCHARGED FROM THE ARMED FORCES OF THE UNITED STATES.

(B)     PROHIBITED.
A PERSON MAY NOT:

(1)      HIDE, SELL, DISPOSE OF, OFFER FOR SALE, PURCHASE, RETAIN
AFTER A DEMAND BY A COMMISSIONED OFFICER OF THE ORGANIZED MILITIA, OR
PLEDGE ANY ARMS, UNIFORMS, EQUIPMENT, OR OTHER MILITARY PROPERTY ISSUED
UNDER THIS TITLE; OR

(2)      WEAR ANY OF THE FOLLOWING ARTICLES OR OBJECTS PRESCRIBED
BY LAW FOR THE USE OF THE ORGANIZED MILITIA:
