In the introductory language of subsection (a) of this section, the term
enlisted "individuals" is substituted for the former term enlisted "men".
See General Revisor's Note to title.

In subsection (a)(3) of this section, the reference to a "residence" is
substituted for the former reference to a "place of abode" for brevity and
conformity to the terminology used throughout this and other revised
articles.

Also in subsection (a)(3) of this section, the reference to mailing to the "last
known residence or business address of the individual" is substituted for
the former reference to mailing "to the post office nearest thereto" to
comply with constitutional notice requirements.

In subsection (b)(1) of this section, the former reference to a "notice" is
deleted as implicit in the reference to a "warning".

In subsection (b)(2)(ii) of this section, the former reference to "good"
evidence is deleted as implicit in the reference to "evidence".

13-704. COMPENSATION FOR MILITIA ORDERED OUT FOR STATE ACTIVE DUTY OR
TRAINING.

(A)      SCOPE OF SECTION.
THIS SECTION:

(1)      APPLIES WHEN THE ORGANIZED MILITIA IS ORDERED OUT FOR
STATE ACTIVE DUTY OR TRAINING BY THE GOVERNOR OR BY THE GOVERNOR'S
AUTHORITY; AND

(2)      DOES NOT APPLY TO THE ORGANIZED MILITIA WHEN ORDERED TO
DUTY INCIDENT TO AN ORDER INTO THE ACTIVE MILITARY SERVICE OF THE UNITED
STATES.

(B)      COMPENSATION FOR OFFICERS, WARRANT OFFICERS, AND ENLISTED
PERSONNEL.

SUBJECT TO SUBSECTION (D) OF THIS SECTION:

(1)      AN OFFICER, WARRANT OFFICER, AND ENLISTED INDIVIDUAL SHALL
RECEIVE THE SAME PAY, INCLUDING LONGEVITY PAY, SUBSISTENCE, PER DIEM, AND
ALLOWANCES, AS AN OFFICER, WARRANT OFFICER, AND ENLISTED INDIVIDUAL OF
LIKE GRADE AND LENGTH OF SERVICE IN THE UNITED STATES ARMY OR AIR FORCE;
AND

(2)      AN INDIVIDUAL ORDERED TO ACTIVE DUTY OTHER THAN FOR
TRAINING SHALL BE PAID A DAILY RATE OF AT LEAST 12 TIMES THE HOURLY
FEDERAL MINIMUM WAGE IN EFFECT AT THE TIME OF ACTIVE DUTY.

(C)      COMPENSATION FOR OTHER PERSONNEL.
