ROBERT L. EHRLICH, JR., Governor

Ch. 5

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 65, § 20.

Throughout this section, references to the United States "Navy", "Marine
Corps", "Air Force", and "Coast Guard" are added as necessary so that all
branches of the armed forces are named. See General Revisor's Note to
title.

In the introductory language of subsection (a) of this section, the reference
to officers "of the organized militia" is added for clarity.

Also in the introductory language of subsection (a) of this section, the
former reference to being recommended "before such appointment" is
deleted as implicit in the requirement that officers must first be
recommended.

In subsections (b)(1), (c)(2), and (d) of this section and throughout this
subtitle, the references to the "United States" are added to modify
references to the named branches of the armed forces to reflect the proper
names of the branches of the armed forces.

In the introductory language of subsection (b) of this section, the
requirement that an individual "shall be" in one of the listed categories is
substituted for the former statement that individuals "shall not be
recognized as such under any of the provisions of this article unless they
shall have been selected from the following classes" for brevity.

In subsection (b)(1)(i) and (iii) of this section, the term enlisted "individual"
is substituted for the former term enlisted "men". See General Revisor's
Note to title.

In subsection (b)(1)(iv) of this section, the reference to the "Air Force
Academy" is added to reflect the current practice of the Department. See
General Revisor's Note to title.

In subsection (b)(1)(v) of this section, the reference to a "school" is
substituted for the former obsolete reference to "camps" for accuracy.

Also in subsection (b)(1)(v) of this section, the conjunction "or" is
substituted for the former conjunction "and" to clarify that an individual
need only satisfy one of the listed criteria to be appointed as an officer.
Similarly, in subsection (c) of this section, the conjunction "or" is
substituted for the former conjunction "and" to clarify that an individual
need not be both a general officer and a colonel at the time of appointment.

In subsection (b)(2) of this section, the former reference to "subscribing]
to" an oath is deleted as included in the reference to "tak[ing]" an oath.

In subsection (c)(1) of this section, the former reference to the National
Guard "of the State" is deleted in light of the defined term "National
Guard" in § 13-101 of this subtitle.
