2003 LAWS OF MARYLAND

(1)      COMMISSIONED OR ASSIGNED OFFICERS; AND

(2)      ABLE-BODIED CITIZENS OF THE STATE WHO VOLUNTEER TO SERVE.

(B)     QUALIFICATIONS.

AN INDIVIDUAL MAY NOT BE COMMISSIONED OR ENLISTED IN THE MARYLAND
DEFENSE FORCE IF THE INDIVIDUAL:

(1)      IS NOT A CITIZEN OF THE UNITED STATES; OR

(2)      HAS BEEN EXPELLED OR DISHONORABLY DISCHARGED FROM A
MILITARY OR NAVAL ORGANIZATION OF THIS STATE OR ANOTHER STATE OR FROM
THE UNITED STATES ARMED FORCES.

(C)     ENLISTING AS ORGANIZATIONS.

A CIVIL ORGANIZATION, SOCIETY, CLUB, POST, ORDER, FRATERNITY,
ASSOCIATION, BROTHERHOOD, BODY, UNION, LEAGUE, OR OTHER COMBINATION OF
PERSONS OR CIVIL GROUPS MAY NOT ENLIST IN THE MARYLAND DEFENSE FORCE AS
AN ORGANIZATION OR UNIT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 65, §§ 71 and 72 and the second sentence of § 62.

In subsection (a) of this section, the former reference "able-bodied persons
of foreign birth who have declared their intentions to become citizens,
resident in the State" is deleted because it conflicts with the provisions of
subsection (b)(1) of this section, which prohibits noncitizens from serving
in the Maryland Defense Force, and as contrary to the practice of the
Military Department.

In the introductory language of subsection (b) of this section, the reference
to an "individual" is substituted for the former reference to a "person". See
General Revisor's Note to title.

In subsection (b)(2) of this section, the phrase "armed forces" is added to
incorporate the various branches of the United States Military.

13-504. COMPENSATION; OATH; ENLISTMENT PERIOD; RESIGNATION.

(A)     COMPENSATION.

A MEMBER OF THE MARYLAND DEFENSE FORCE WHO IS ORDERED TO ACTIVE
DUTY BY THE GOVERNOR OR BY THE GOVERNOR'S AUTHORITY IS ENTITLED TO THE
COMPENSATION SPECIFIED FOR OFFICERS AND ENLISTED INDIVIDUALS AS
PROVIDED UNDER § 13-704 OF THIS TITLE.

(B)     OFFICER'S OATH.
