Ch. 5                                        2003 LAWS OF MARYLAND

(II) AN OFFICER OR WARRANT OFFICER AND AGREES IN WRITING
TO SERVE FOR A MINIMUM OF 24 MONTHS.

(2) THE 24-MONTH REQUIREMENT RUNS FROM THE FIRST DAY OF
CLASSES FOR THE SEMESTER

(D) EFFECT OF DISCHARGE.

IF A RECIPIENT OF TUITION ASSISTANCE UNDER THIS SECTION IS DISCHARGED
FROM THE NATIONAL GUARD FOR A REASON DESIGNATED BY THE ADJUTANT
GENERAL, THE ASSISTANCE TERMINATES AND THE MEMBER SHALL REIMBURSE THE
DEPARTMENT THE AMOUNT OF TUITION ASSISTANCE RECEIVED FOR THAT
SEMESTER WITHIN 30 DAYS OF DISCHARGE.

REVISOR'S NOTE: This section formerly was Art. 65, § 12A.

In subsection (d) of this section, the reference to a requirement that a
member "reimburse" the Department is substituted for the former
reference to a member "ow[ing]" the Department for clarity.

Defined terms: "Department" § 13-101
"National Guard" § 13-101

SUBTITLE 5. MARYLAND DEFENSE FORCE.
13-501. ESTABLISHED.

(A)     IN GENERAL.

(1)      THE GOVERNOR MAY ORGANIZE AND MAINTAIN IN THE STATE A
MARYLAND DEFENSE FORCE.

(2)      THE GOVERNOR MAY DISBAND OR REDUCE THE SIZE OF THE
MARYLAND DEFENSE FORCE AT ANY TIME.

(B)     SEPARATE FROM NATIONAL GUARD.

THE MARYLAND DEFENSE FORCE IS IN ADDITION TO AND SEPARATE FROM THE
NATIONAL GUARD.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 65, § 62, as it related to the organization,
maintaining, and naming of the Maryland Defense Force.

In subsection (a)(1) of this section, the former phrase "as the Governor may
deem necessary" is deleted as unnecessary in light of the word "may".
Similarly, in subsection (a)(2) of this section, the former reference to any
time "he deems proper" is deleted as unnecessary in light of the phrase
"may ... at any time".

Defined terms: "Maryland Defense Force" § 13-101
"National Guard" § 13-101
