JURISDICTION, THE MARYLAND-NATIONAL CAPITAL PARK AND PLANNING
COMMISSION, OR THE WASHINGTON SUBURBAN SANITARY COMMISSION AFTER
ADOPTION OF THE MBRC.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 83B, § 6-503(a), (b), and (d).

In subsection (c) of this section, the reference to "this subtitle and Subtitles
2, 3, 4, and 5 of this title" is substituted for the former reference to "this
title" to reflect the organization of this revised article.

Former Art. 83B, § 6-503(c)(l), which required the Department of Housing
and Community Development to submit proposed regulations adopting the
Maryland Building Rehabilitation Code to the Joint Committee on
Administrative, Executive, and Legislative Review on or before December
31, 2000, and to adopt the MBRC as soon as possible thereafter, is deleted
as obsolete. The proposed regulations were published in the Maryland
Register
on February 9, 2001, and adopted by the Department on May 4,
2001, effective June 1, 2001. For the text of the final regulations, see
COMAR 05.16.

12-1005. SAME — CONTENTS.

(A) MINIMUM REQUIREMENTS.

AT A MINIMUM, THE MBRC SHALL:

(1)      MAINTAIN A LEVEL OF SAFETY CONSISTENT WITH EXISTING CODES;

(2)      PROVIDE FOR MULTIPLE CATEGORIES OF WORK WITH MULTIPLE
COMPLIANCE STANDARDS;

(3)      BE ENFORCEABLE BY LOCAL OFFICIALS USING EXISTING
ENFORCEMENT PROCEDURES;

(4)      APPLY TO THE REPAIR, RENOVATION, MODIFICATION, AND
RECONSTRUCTION OF, A CHANGE OF OCCUPANCY IN, AND AN ADDITION TO, AN
EXISTING BUILDING;

(5)      PROVIDE AN EXPEDITED REVIEW PROCESS FOR PROPOSED
AMENDMENTS TO THE MBRC SUBMITTED BY A LOCAL GOVERNMENT OR AN
ORGANIZATION THAT REPRESENTS LOCAL GOVERNMENTS; AND

(6)      PROVIDE AN OPPORTUNITY FOR A PERSON PROPOSING A COMPLEX
PROJECT THAT INVOLVES MULTIPLE CODES TO MEET, BEFORE SUBMITTING A
CONSTRUCTION PERMIT APPLICATION, WITH THE LOCAL OFFICIALS, OR THEIR
