Ch. 5

(I)      MAY NOT RECEIVE A SALARY AS A MEMBER OF THE BOARD;
BUT

(II)     IS ENTITLED TO:

1.       COMPENSATION IN ACCORDANCE WITH THE STATE
BUDGET; AND

2.       REIMBURSEMENT FOR EXPENSES UNDER THE STANDARD
STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE BUDGET.

(H) AUTHORITY OF SECRETARY.

THE EXERCISE OR PERFORMANCE OF THE POWERS, AUTHORITY, DUTIES, AND
FUNCTIONS OF THE BOARD UNDER THIS SUBTITLE IS SUBJECT TO THE POWER AND
AUTHORITY OF THE SECRETARY.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48, § 169.

In subsection (a) of this section, the phrase "in the Department of Labor,
Licensing, and Regulation" is added for clarity.

In subsection (b)(2)(v) of this section, the reference to "an insurer
authorized" to insure boilers or pressure vessels is substituted for the
former reference to "a company licensed" to insure them for accuracy
because insurers receive certificates of authority, not licenses.

In subsection (d)(2) of this section, standard language is substituted for the
second sentence of former Art. 48, § 169(d), which provided for the terms of
the initial members of the Board and was obsolete. This substitution is not
intended to alter the term of any member of the Board. See § 16 of Ch. 5,
Acts of 2003.

In subsection (g)(2)(ii)1 of this section, the former reference to
compensation for "each day or part thereof necessarily spent in the
discharge of their official duties" is deleted as unnecessary in light of the
reference to "compensation in accordance with the State budget" and to
reflect that members of the Board no longer receive per diem pay.

In subsection (h) of this section, the former phrase "as set forth in the
Business Regulation Article or elsewhere in the laws of this State" is
deleted as an unnecessary general reference to every provision of law in
which the Secretary's authority is set forth.
