requirement that there be a final acceptance inspection of elevator units is
implicit in the requirement that the contractor schedule a final acceptance
inspection and the prohibition that an elevator unit may not be operated
without a certificate of inspection and registration.

Subsection (b) of this section is revised as a requirement for the
Commissioner to provide an inspection checklist rather than as a
definition of "inspection checklist" for clarity.

In subsections (b) and (c)(1) of this section, the reference to the "Safety
Code and other regulations adopted by the Commissioner" is substituted
for the former references to "applicable safety codes and rules and
regulations adopted by the Commissioner" for specificity and to use the
defined term.

In subsection (d) of this section, the former reference to the "elevator,
dumbwaiter, escalator, or moving walk" contractor is deleted as
unnecessary given the context of the provision.

12-811. ISSUANCE OF CERTIFICATE; POSTING; SCOPE.

(A)     ISSUANCE OF CERTIFICATE.

IF AN INSPECTION DISCLOSES THAT AN ELEVATOR UNIT COMPLIES WITH THE
SAFETY CODE AND OTHER REGULATIONS ADOPTED BY THE COMMISSIONER, THE
COMMISSIONER SHALL ISSUE A CERTIFICATE TO THE OWNER OR LESSEE OF THE
ELEVATOR UNIT.

(B)     POSTING.

THE CERTIFICATE SHALL BE POSTED CONSPICUOUSLY IN OR ON THE
ELEVATOR UNIT.

(C)     SCOPE OF CERTIFICATE.

WHILE A CERTIFICATE IS IN EFFECT, IT AUTHORIZES THE HOLDER TO OPERATE
THE ELEVATOR UNIT IN A BUILDING, STRUCTURE, OR PLACE OF EMPLOYMENT IN
THE STATE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the second clause of former Art. 89, § 49B(a) and the first and
third sentences of (i)(l).

In subsection (a) of this section, the reference to the "Safety Code" is
substituted for the former reference to the "applicable safety code, as
adopted by the Commissioner" for specificity and to use the defined term.

In subsection (b) of this section, the former phrase "when issued" is deleted
as surplusage.
