on the former definition of "authorized electrical inspection agency" in
former Art. 38A, § 59(a)(2), which stated that the State Fire Marshal
approved organizations to inspect electrical installations for conformity
with the National Electrical Code or a local code.

In subsection (a)(2) of this section, the former reference to the "Department
of State Police" is deleted as surplusage because the State Fire Marshal is
the operative entity, not the Department of State Police. The fact that the
State Fire Marshal is in the Department of State Police is unnecessary
verbiage.

The Public Safety Article Review Committee notes, for consideration by the
General Assembly, that individuals as well as organizations may be
authorized electrical inspection agencies to which qualification certificates
may be issued under subsection (a)(2) of this section.

12-606. INSTALLATION OF ELECTRICAL WIRING BY HOMEOWNERS.

(A)     SCOPE OF SECTION.

THIS SECTION APPLIES IN CHARLES COUNTY AND ST. MARYS COUNTY.

(B)     IN GENERAL.

IN A COUNTY SUBJECT TO THIS SECTION, A HOMEOWNER MAY INSTALL
ELECTRICAL WIRING IN A HOME THAT IS TO BE USED AS THE HOMEOWNER'S
RESIDENCE SUBJECT TO STANDARDS SET BY THE COUNTY COMMISSIONERS.

(C)     REGULATIONS.

(1)      THE COUNTY COMMISSIONERS OF CHARLES COUNTY MAY ADOPT
REGULATIONS TO GOVERN THE ISSUANCE OF PERMITS TO HOMEOWNERS UNDER
THIS SECTION.

(2)      THE COUNTY COMMISSIONERS OF ST. MARYS COUNTY SHALL ADOPT
REGULATIONS TO GOVERN THE ISSUANCE OF PERMITS TO HOMEOWNERS UNDER
THIS SECTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 38A, §§ 65 and 66.

In subsection (b) of this section, the former reference to a "personal"
residence is deleted as included in the reference to the "homeowner's"
residence.
