2003 LAWS OF MARYLAND

(V) TWO MEMBERS SHALL BE EX OFFICIO MEMBERS, WHOM THE
GOVERNOR MAY CHOOSE FROM ADMINISTRATIVE UNITS OF THE STATE.

(B) TENURE; VACANCIES.

(1)      THE TERM OF A MEMBER IS 5 YEARS.

(2)      THE TERMS OF MEMBERS ARE STAGGERED AS REQUIRED BY THE
TERMS PROVIDED FOR MEMBERS OF THE COUNCIL ON OCTOBER 1, 2003.

(3)      AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)      A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN SERVES
ONLY FOR THE REST OF THE TERM AND UNTIL A SUCCESSOR IS APPOINTED AND
QUALIFIES.

(5)      IF A VACANCY OCCURS, THE COUNCIL SHALL RECOMMEND A
REPLACEMENT TO THE GOVERNOR.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 88B, § 30A(c).

In subsection (a)(1) of this section, the former reference to "not more than"
19 members is deleted as surplusage.

In subsection (a)(2)(ii) and (v) of this section, the reference to "units" is
substituted for the former reference to "agencies". See General Revisor's
Note to article.

In subsection (a)(2)(ii)4 of this section, the reference to the "Department of
the Environment" is added for clarity. See EN § 15-201.

In subsection (a)(2)(iv)1 of this section, the reference to vibration
"technology" is substituted for the former reference to a vibration
"technologist" for grammatical consistency. Similarly, in subsection
(a)(2)(iv)2 of this section, the reference to "pyrotechnics" is substituted for
the former reference to "[p]yrotechnic specialists".

In subsection (a)(2)(v) of this section, the former reference to "the
Governor's discretion" is deleted as redundant in light of the power of the
Governor to choose ex officio members from administrative units.

In subsection (b)(2) of this section, the reference to "October 1, 2003" is
substituted for the former obsolete reference to "July 1, 1984" to reflect the
effective date of this revision. This substitution is not intended to alter the
term of any member of the Board. See § 16 of Ch. 5, Acts of 2003.
