(2) COMPENSATION PROVIDED UNDER THIS SUBSECTION MAY NOT
EXCEED AN EMPLOYEE'S STATE BASE SALARY OR DIRECT WAGES.

(D)     AN EMPLOYEE ELIGIBLE TO RECEIVE MILITARY ADMINISTRATIVE LEAVE
UNDER THIS SECTION WHO IS ACTIVATED FOR MILITARY DUTY ON OR AFTER JULY 1,

2003,  SHALL ELECT TO USE EITHER MILITARY ADMINISTRATIVE LEAVE OR PAID
LEAVE AS PROVIDED IN § 9-1104(3) OF THIS SUBTITLE.

(E)     THE DEPARTMENT SHALL KEEP A RECORD OF THE USE OF MILITARY
ADMINISTRATIVE LEAVE UNDER THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 2003. It shall remain effective for a period of 1 year and, at the end of June 30,

2004,  with no further action required by the General Assembly, this Act shall be
abrogated and of no further force and effect.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed House Bill 824 - Assisted Living Facilities - Certification - Third Party
Accreditation Programs.

This bill will authorize the Department of Health and Mental Hygiene to accept all or
part of a specified accrediting report as meeting the State licensing requirements for
the renewal of a license to operate an assisted living facility program.

Senate Bill 553, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign House
Bill 824.

FOR the purpose of requiring authorizing the Department of Health and Mental
Hygiene to establish and enforce certain standards to certify third party assisted
living accreditation programs; requiring certain standards to authorize the
acceptance of a certain survey as sufficient for compliance with certain licensure
