REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 25, § 3(w-1).

Throughout this section, the term "volunteer fire company" is substituted
for the former references to "fire companies" and "companies" for
consistency throughout this section.

Subsection (a) of this section is revised to clarify the scope of this section. It
is based on the reference in former Art. 25, § 3(w-1)(1) to the County
Commissioners of Dorchester County.

In subsection (c) of this section, the phrase "shall use property tax revenue"
is substituted for the former phrase "shall levy each year on the assessable
property" for clarity.

Also in subsection (c) of this section, the former phrase "as determined by
the County Commissioners in accordance with this subsection" is deleted
as surplusage.

In subsection (e)(1) of this section, the phrase "submit evidence satisfactory
to the County Commissioners" is substituted for the former phrase "show
to the satisfaction of the Commissioners" for brevity and clarity.

Subsection (e)(2)(i) of this section is revised to state expressly that which
was implied in the former law, i.e., in order to allocate a volunteer fire
company's money to the contingent fund, the County Commissioners must
first withhold the money from the volunteer fire company.

8-303. GUARANTEE OF LOANS TO VOLUNTEER FIRE COMPANIES.

(A)     SCOPE OF SECTION.

THIS SECTION APPLIES TO ALLEGANY COUNTY, CALVERT COUNTY, CHARLES
COUNTY, FREDERICK COUNTY, GARRETT COUNTY, KENT COUNTY, AND ST. MARYS
COUNTY.

(B)     EXPRESS POWER

THE COUNTY COMMISSIONERS OF A COUNTY SUBJECT TO THIS SECTION HAVE
THE EXPRESS POWER TO GUARANTEE OR INSURE FINANCIAL LOANS MADE BY A
GOVERNMENTAL THIRD PARTY TO A VOLUNTEER FIRE COMPANY THAT:

(1)      IS LOCATED WITHIN THE COUNTY; OR

(2)      HAS A MUTUAL AID AGREEMENT WITH THE COUNTY.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 25, § 3(a)(1) and (gg).

In the introductory language of subsection (b) of this section, the reference
to a "fire company" is substituted for the former reference to a "fire
department" for consistency within this title.
