2003 LAWS OF MARYLAND

4.       WHILE ACTIVELY PARTICIPATING IN THE EMERGENCY
MEDICAL SERVICES UNIT, OR RESCUE WORK OF A VOLUNTEER ADVANCED LIFE
SUPPORT UNIT OR A VOLUNTEER FIRE, AMBULANCE, OR RESCUE COMPANY
LOCATED IN THE STATE; OR

5.       WHILE PROVIDING EMERGENCY OR RESCUE ASSISTANCE,
WHETHER ACTING ALONE OR AT THE DIRECTION OF OR WITH A FIRE, AMBULANCE,
OR RESCUE COMPANY OR ADVANCED LIFE SUPPORT UNIT.

(2) A BENEFIT UNDER THIS SECTION SHALL BE PAID:

(I)      REGARDLESS OF THE DISTRICT IN WHICH THE BENEFICIARY
WAS DISABLED; OR

(II)     REGARDLESS OF WHETHER THE BENEFICIARY WAS DISABLED
IN THIS STATE, DELAWARE, THE DISTRICT OF COLUMBIA, PENNSYLVANIA, VIRGINIA,
OR WEST VIRGINIA.

(B)     AMOUNT AND MANNER OF PAYMENT.

THE BOARD SHALL PAY A BENEFIT UNDER THIS SECTION FROM THE TREASURY
OF THE MARYLAND STATE FIREMEN'S ASSOCIATION IN THE AMOUNT AND IN THE
MANNER THAT THE BOARD DETERMINES UNTIL THE BENEFICIARY IS NO LONGER
DISABLED.

(C)     NAME OF BENEFICIARY ADDED TO LIST.

THE SECRETARY OF THE BOARD SHALL ADD THE NAME OF EACH BENEFICIARY
UNDER THIS SECTION TO THE DISABLED FIREMEN'S AND RESCUE SQUADMEN'S LIST.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 38A, § 42(b), (c), (d), and (e).

Throughout this section, references to a "member" of a volunteer fire
company or volunteer rescue squad are substituted for the former
references to a "person" who is a volunteer "firefighter", "individual"
serving on a volunteer rescue squad, and "person" for clarity and
consistency throughout this section and this subtitle.

In the introductory language of subsection (a)(1) of this section, the word
"disability" is added to modify "benefits" to distinguish disability benefits
from the death benefits and pension benefits also provided for in this
subtitle.

Also in the introductory language of subsection (a)(1) of this section, the
reference to the "Maryland State Firemen's Association" is substituted for
the former reference to the "Board" to clarify that the Association is
responsible for funding death benefits.

In subsection (a)(1)(ii)4 of this section, the reference to a volunteer unit or
company "located" in the State is added to clarify that the volunteer unit or
company must be located in the State.
