(ii) within the preceding 5 years, the failure to perform or of
unsatisfactory performance in accordance with the terms of one or more contracts,
unless the failure to perform or unsatisfactory performance was caused by acts
beyond the control of the person; [or]

(4) WITHIN THE PRECEDING 5 YEARS, IF THE PERSON HAS ENGAGED IN
A PATTERN OF VIOLATIONS OF FEDERAL OR STATE LABOR LAWS, CIVIL RIGHTS
LAW
S, OR ENVIRONMENTAL PROTECTION LAWS BEEN CRIMINALLY CONVICTED OF,
OR FOUND CIVILLY LIABLE FOR, AT LEAST TWO VIOLATIONS OF ANY FEDERAL OR
MARYLAND:

(I) LABOR LAW, IF THE VIOLATIONS SIGNIFICANTLY IMPACT THE
HEALTH OR SAFETY OF WORKERS
;

(II) CIVIL RIGHTS LAW; OR

(III) ENVIRONMENTAL PROTECTION LAW, IF THE VIOLATIONS
SIGNIFICANTLY IMPACT THE HEALTH OR SAFETY OF WORKERS OR MEMBERS OF THE
GENERAL PUBLIC
; OR

(5) IF WITHIN THE PRECEDING 5 YEARS, THE PERSON HAS:

(I) COMMITTED MULTIPLE VIOLATIONS OF ANY FEDERAL,
MARYLAND, OR A CONTIGUOUS JURISDICTION'S LABOR LAW, CIVIL RIGHTS LAW, OR
ENVIRONMENTAL PROTECTION LAW; AND

(II) AS A RESULT OF THE VIOLATIONS, BEEN SUBJECT TO
MULTIPLE SEPARATE AND DISTINCT FINDINGS OF CIVIL LIABILITY IN MARYLAND OR
A CONTIGUOUS JURISDICTION; OR

(5) (6) for any other cause that the Board determines to be so serious
as to affect the integrity of the procurement process.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2003.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed Senate Bill 133 - Criminal Law - Child Abuse and Child Sexual Abuse -
Increased Penalties.

This bill establishes the crimes of child abuse in the first and second degrees,
establishes terms of imprisonment for those crimes, establishes a subsequent offender
penalty, and increases from 15 to 25 years the maximum term of imprisonment for a
person who causes sexual abuse to a minor. The bill also adds a definition of severe
