even though this subtitle is derived, in part, from material outside of
former Art. 27, § 36-I. Because the material revised in this subtitle that
was not contained in former Art. 27, § 36-I does not affect the application
of this subtitle in a way contrary to the material set forth here, no
substantive change results.

In subsection (a) of this section, the statement that this subtitle "does not
affect a person's right to" manufacture certain weapons is substituted for
the former statement that "[n]othing in this section shall be construed to
interfere with ... a person's ability to" manufacture as a more precise
statement of the effect of this subtitle.

In subsection (b)(1) and (2) of this section, the former references to an
"entity" are deleted in light of the definition of "person".

In subsection (b)(1) of this section, the phrase "is not strictly liable" is
substituted for the former phrase "may not be held strictly liable" for
clarity.

Also in subsection (b)(1) of this section, the former reference to damages "of
any kind" is deleted as surplusage. Similarly, the former reference to
injuries "sustained" is deleted.

5-403. REGULATIONS.

THE SECRETARY SHALL ADOPT REGULATIONS NECESSARY TO CARRY OUT THIS
SUBTITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 36-I(e).

The former requirement to adopt regulations "[s]ubject to the provisions of
the Administrative Procedure Act" is deleted in light of SG § 10-102, which
extends the Administrative Procedure Act to the Secretary.

The former reference adopting "rules" is deleted in light of the reference to
adopting "regulations". See General Revisor's Note to article.
