2003 LAWS OF MARYLAND
(I) THE HUMAN RELATIONS DEPARTMENT OR OTHER PARTY TO
APPEAL A DECISION OR ORDER OF THE HUMAN RELATIONS COMMISSION TO THE
CIRCUIT COURT FOR FREDERICK COUNTY IN ACCORDANCE WITH TITLE 7, CHAPTER
200 OF THE MARYLAND RULES; AND
(II) THE HUMAN RELATIONS COMMISSION TO BE A PARTY TO AN
APPEAL MADE TO THE CIRCUIT COURT FOR FREDERICK COUNTY.
(4) (I) IN EMPLOYMENT CASES, AN AWARD OF MONETARY DAMAGES:
1. MAY NOT EXCEED A 36-MONTH PERIOD; AND
2. SHALL BE REDUCED BY ANY EARNINGS RECEIVED
DURING THAT PERIOD OR ANY AMOUNTS EARNABLE DURING THAT PERIOD WITH
REASONABLE DILIGENCE BY THE EMPLOYEE DISCRIMINATED AGAINST.
(II) IN PUBLIC ACCOMMODATIONS CASES AND HOUSING CASES, AN
AWARD OF RELIEF IS RESTRICTED TO ACTUAL MONETARY DAMAGES AND
EQUITABLE RELIEF.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2003.

AN ACT concerning
Montgomery County - Highway Project Funding - Repeal of Prohibitions
Restrictions

FOR the purpose of repealing altering the property to which a certain provision of law
that prohibits the Department of Transportation is prohibited from spending
further funds for the construction of a new highway, arterial, freeway, or
expressway in a certain right of way in Montgomery County reserved for the
Rockville Facility project applies; providing that a certain prohibition does not
preclude construction of certain roadway crossings or trails; and generally
relating to repealing certain provisions restricting the Department of
Transportation from spending further funds on certain highway construction
projects in Montgomery County.
