BY THIS SECTION.

(F) SUBJECT MAY CONTEST CONTENTS.

THE SUBJECT OF A CRIMINAL HISTORY RECORDS CHECK UNDER THIS SECTION
MAY CONTEST THE CONTENTS OF THE PRINTED STATEMENT ISSUED BY THE
CENTRAL REPOSITORY AS PROVIDED IN § 10-223 OF THE CRIMINAL PROCEDURE
ARTICLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 443(c).

In subsections (b), the introductory language of (c), and (d) of this section,
the defined term "Secretary" is substituted for the former reference to the
"Department of State Police" to conform to the terminology used in other
provisions of this subtitle relating to dealer's licenses. See, e.g., §§
5-106(a), 5-107(a)(1), 5-109, and 5-110 of this subtitle.

In subsection (b) of this section, the reference to each applicant "for a
dealer's license" is added for clarity.

5-109. INVESTIGATION OF APPLICANT FOR DEALER'S LICENSE;

THE SECRETARY SHALL CONDUCT AN INVESTIGATION TO DETERMINE THE
TRUTH OR FALSITY OF THE INFORMATION SUPPLIED AND THE STATEMENTS MADE
IN AN APPLICATION FOR A DEALER'S LICENSE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 27, § 443(f).

5-110. DISAPPROVAL OF DEALER'S LICENSE APPLICATION.

(A)     GROUNDS.

THE SECRETARY SHALL DISAPPROVE AN APPLICATION FOR A DEALER'S
LICENSE IF:

(1)      THE SECRETARY DETERMINES THAT THE APPLICANT SUPPLIED
FALSE INFORMATION OR MADE A FALSE STATEMENT;

(2)      THE SECRETARY DETERMINES THAT THE APPLICATION IS NOT
PROPERLY COMPLETED; OR

(3)      THE SECRETARY RECEIVES A WRITTEN NOTIFICATION FROM THE
APPLICANT'S LICENSED ATTENDING PHYSICIAN THAT THE APPLICANT SUFFERS
FROM A MENTAL DISORDER AND IS A DANGER TO THE APPLICANT OR TO ANOTHER

(B)     NOTICE.
