Ch. 252                                    2003 LAWS OF MARYLAND

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

14-207.

(e) (1) The Board shall pay all fees collected under the provisions of this title
to the Comptroller of the State.

(2) The Comptroller shall distribute[:

(i) 14 percent of the fees received from the Board to the Office of
Student Financial Assistance to be used as follows:

1. One half to make grants under the Health Manpower
Shortage Incentive Grant Program under § 18-803 of the Education Article; and

2. One half to make grants under the Janet L, Hoffman
Loan Assistance Repayment Program under 18-1502(c) of the Education Article to
physicians engaged in primary care or to medical residents specializing in primary
care who agree to practice for at least 2 years as primary care physicians in a
geographic area of the State that has been designated by the Secretary of Health and
Mental Hygiene as being medically underserved; and

(ii) The balance of] the fees to the Board of [Physician Quality
Assurance] PHYSICIANS Fund.

SECTION 3. 2. AND BE IT FURTHER ENACTED, That the term of office of
each member of the State Board of Physicians who is serving on the Board on the
effective date of this Act shall expire on July 30 July 31, 2003.

SECTION 4. 3. AND BE IT FURTHER ENACTED, That on August 1, 2003, the
Governor, with the advice of the Secretary of Health and Mental Hygiene and the
advice and consent of the Senate, shall appoint a new State Board of Physicians in
accordance with the provisions of § 14-202 of the Health Occupations Article.

SECTION 5. 4. AND BE IT FURTHER ENACTED, That the terms of the
members of the State Board of Physicians appointed on August 1, 2003 shall expire as
follows:

(1)     four physician members and one consumer member in 2005;

(2)     four physician members and one consumer member in 2006;

(3)     four physician members and one consumer member in 2007; and

(4)     four physician members and two consumer members in 2008.

SECTION 6. AND BE IT FURTHER ENACTED, That the State Board of
Physicians shall report to the Governor, the Senate Education, Health, and
Environmental Affairs Committee, the Senate Budget and Taxation Committee, the
House Health and Government Operations Committee, and the House Appropriations
Committee on or before November 1, 2003, in accordance with § 2-1246 of the State
