(1) On a first offense, may contact a law enforcement officer; and
(2) On a second or subsequent offense, shall immediately contact a law
enforcement officer.
[(f)] —(G)—A law enforcement officer contacted by school authorities in
accordance with subsection [(e)] (F) of this section:
(1) Shall immediately inquire as to the reasons the individual possesses
the pager; and
(2) May arrest the violator.
[(g)] (H) Any person who violates subsection (o) OR (D) of this section is
guilty of a misdemeanor and on conviction is subject to a fine not exceeding $2,500,
imprisonment not exceeding 6 months, or both.
SECTION 2. AND BE IT FURTHER ENACTED, That, except as provided in §
26-104 of the Education Article, as enacted by Section 1 of this Act, it is the intent of
the General Assembly that local education agencies, working with the State
Department of Education, develop their own local policies regarding the use of
portable pagers and cellular telephones on public school property and, in enacting
Section 1 of this Act, it is not the intent of the General Assembly to encourage the use
of portable pagers and cellular telephones on public school property during school
hours in any county.
SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2003.

AN ACT concerning
Department of Health and Mental Hygiene - State Board of Physicians
FOR the purpose of renaming the State Board of Physician Quality Assurance to be
the State Board of Physicians (Board); continuing the Board in accordance with
the provisions of the Maryland Program Evaluation Act by extending to a
certain date the termination provisions relating to the statutory and regulatory
authority of the Board; requiring that an evaluation of the Board and the
statutes and regulations that relate to the Board be performed on or before a
certain date; repealing a provision requiring the Health Claims Arbitration
Office (HCAO) to forward certain information to the Medical and Chirurgical
Faculty of Maryland (Faculty); adding certain members to the membership of
the Board; altering the requirements for certain practicing licensed physician
members of the Board; altering the appointment process for certain physician
