Article - Courts and Judicial Proceedings

12-701.

(a) (1) An appeal from an orphans' court or a circuit court stays all
proceedings in the orphans' court concerning the issue appealed.

(2)     An appeal from an orphans' court or a circuit court does not stay any
proceedings in the orphans' court that do not concern the issue appealed, if the
orphans' court can provide for conforming to the decision of the appellate court.

(3)      (I) AN APPEAL FROM A FINAL ORDER OF AN ORPHANS' COURT OR A
CIRCUIT COURT REMOVING A PERSONAL REPRESENTATIVE DOES NOT STAY AN
ORDER APPOINTING A SUCCESSOR PERSONAL REPRESENTATIVE OR SPECIAL
ADMINISTRATOR

(II) IF AN APPEAL IS FILED FROM THE FINAL ORDER OF AN
ORPHANS' COURT OR A CIRCUIT COURT REMOVING A PERSONAL REPRESENTATIVE
AND THE COURT APPOINTED A SUCCESSOR PERSONAL REPRESENTATIVE, THE
SUCCESSOR PERSONAL REPRESENTATIVE SHALL HAVE THE POWERS OF A SPECIAL
ADMINISTRATOR

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
construed to apply only prospectively and may not be applied or interpreted to have
any effect on or application to any appeal filed before the effective date of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2003.

AN ACT concerning

Health - Pharmacies - Electronic Reimbursement by the Department of

Health and Mental Hygiene

FOR the purpose of authorizing certain pharmacies to receive a certain
reimbursement electronically from the Department of Health and Mental
Hygiene under the Maryland Medical Assistance Program; providing that this
Act does not apply to a person providing pharmacy benefit manager services;
providing for a delayed effective date; and generally relating to the electronic
claim reimbursement of pharmacies by the Department of Health and Mental
Hygiene.

BY repealing and reenacting, without amendments,
