(a)     (1) A person who willfully violates any provision of this subtitle or any
rule or regulation adopted under this subtitle is liable for a civil penalty not exceeding
$5,000 to be collected in a civil action.

(2)     Each day a violation continues is a separate violation under this
subsection.

(3)     If the Attorney General concurs, the Secretary may compromise and
settle any claim for a civil penalty under this subtitle.

(b)     A person [who previously has been assessed a civil penalty under this
subtitle and] who KNOWINGLY AND willfully violates any provision of this subtitle or
any rule or regulation adopted under this subtitle is guilty of a misdemeanor and, on
conviction, is subject:

(1)     For a first offense, to a fine not exceeding $20,000 OR
IMPRISONMENT NOT EXCEEDING 1 YEAR OR BOTH; or

(2)     For a second or subsequent offense, to a fine not exceeding $25,000,
or imprisonment not exceeding 2 years or both.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2003.

AN ACT concerning

Maryland African American Museum Corporation - Board of Directors -

New Members

FOR the purpose of altering the number of members of the Maryland African
American Museum Corporation Board of Directors; authorizing the Governor to
appoint to the Board of Directors up to a certain number of members from
outside the State under certain circumstances; establishing certain criteria for a
quorum at board meetings; providing for certain terms; making this Act an
emergency measure; and generally relating to new members of the Maryland
African American Museum Corporation Board of Directors.
