3-304. APPLICATIONS FOR COMMISSIONS.

(A)     EMPLOYER TO SUBMIT.

(1)      THE EMPLOYER OF AN APPLICANT FOR A COMMISSION SHALL
SUBMIT THE APPLICATION UNDER THIS SECTION.

(2)      A SEPARATE APPLICATION IS REQUIRED FOR EACH INDIVIDUAL
APPLICANT FOR A COMMISSION.

(B)     CONTENTS; FEES.

(1)      THE EMPLOYER OF AN APPLICANT FOR A COMMISSION SHALL:

(I)      SUBMIT TO THE SECRETARY AN APPLICATION ON THE FORM
THAT THE SECRETARY REQUIRES;

(II)     SUBMIT TO THE SECRETARY A COMPLETE SET OF THE
APPLICANT'S LEGIBLE FINGERPRINTS ON STANDARD FINGERPRINT CARDS;

(III)   PAY TO THE SECRETARY A FEE TO COVER THE COST OF THE
FINGERPRINT RECORD CHECKS; AND

(IV)    SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION, PAY TO THE
SECRETARY AN APPLICATION FEE OF $100, TO COVER THE COST OF AN
INVESTIGATION OF THE APPLICANT.

(2)      THE APPLICATION FEE IS NONREFUNDABLE IF THE APPLICATION IS
DENIED.

(3)      AN APPLICATION FEE MAY NOT BE CHARGED TO A UNIT OF THE
STATE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-902(b) and (a)(1), (2), and the first and
second sentences and, except as it related to the renewal fee, the third
sentence of (4).

In subsection (b)(1)(ii) and (iii) of this section, the reference to the
"Secretary" is substituted for the former reference to the "Department" for
consistency with subsection (b)(1)(i) and (iv) of this section.

In subsection (b)(1)(iii) of this section, the former reference to the
fingerprint "card" record checks is deleted as surplusage.
