SUBTITLE 3. SPECIAL POLICE OFFICERS.
3-301. DEFINITIONS.

(A)     IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language used as the standard
introductory language to a definition section.

(B)     COMMISSION.

"COMMISSION" MEANS A SPECIAL POLICE COMMISSION ISSUED UNDER THIS
SUBTITLE.

REVISOR'S NOTE: This subsection is new language added to standardize the
reference to commissions issued to special police officers under this
subtitle. The definition is based on the first and second sentences of former
Art. 41, § 4-901.

(C)     SECRETARY.

"SECRETARY" MEANS THE SECRETARY OF STATE POLICE.

REVISOR'S NOTE: This subsection is new language added to avoid repetition
of the full title "Secretary of State Police".

(D)     SPECIAL POLICE OFFICER.

"SPECIAL POLICE OFFICER" MEANS AN INDIVIDUAL WHO HOLDS A COMMISSION
ISSUED UNDER THIS SUBTITLE.

REVISOR'S NOTE: This subsection is new language added to avoid repetition
of phrases such as "individual appointed as a special police officer",
"individual appointed under this subtitle", and "special police officer who
receives a commission under this subtitle".

Defined term: "Commission" § 3-301
3-302. GOVERNOR TO APPOINT SPECIAL POLICE OFFICERS.

THE GOVERNOR MAY APPOINT AND DEPUTIZE AS A SPECIAL POLICE OFFICER
EACH INDIVIDUAL THAT THE GOVERNOR CONSIDERS QUALIFIED FOR A
COMMISSION.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 41, § 4-901.

In this section and throughout this subtitle, the reference to an
"individual" is substituted for the former reference to a "person[s]" because
only an individual, and not the other entities included in the defined term
"person", may be commissioned as a special police officer. See § 1-101 of
this article for the definition of "person".
