2003 LAWS OF MARYLAND

(d)     A person who violates this section is guilty of a misdemeanor and on
conviction is subject to imprisonment not exceeding 6 months or a fine not exceeding
$1,000 or both.

(e)     (1) An individual who was under visual surveillance in violation of this
section has a civil cause of action against any person who conducted or procured
another to conduct the visual surveillance.

(2) In an action under this subsection, the court may award actual
damages and reasonable attorney's fees.

(f)      This section does not affect any legal or equitable right or remedy
otherwise provided by law.

(g)     This section does not affect the application of § 3-901 of this subtitle.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2003.

(House Bill 567)

AN ACT concerning

Talbot County - Applicants for Alcoholic Beverages Licenses - Criminal

History Records Check

FOR the purpose of requiring the Board of Liquor License Commissioners of Talbot
County to require an applicant for a new alcoholic beverages license or for a
transfer of an existing alcoholic beverages license to be fingerprinted and be the
subject of a State and national criminal history records check; prohibiting the
Board from disseminating certain information to certain persons; authorizing
the Board to disseminate certain information to members of the Board and their
designees; authorizing the Board to charge certain applicants for certain costs;
authorizing the Board to make a certain exemption for certain persons; defining
certain terms; making this Act an emergency measure; and generally relating to
alcoholic beverages licenses in Talbot County.
