FOR the purpose of clarifying the application of the State Open Meetings Act to
certain actions of the Howard County Board of Education; clarifying that the
County Board may take certain actions in a closed session in accordance with
certain provisions of the State Open Meetings Act; providing for the termination
of this Act; and generally relating to the clarification of the application of the
State Open Meetings Act to certain actions of the Howard County Board of
Education.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

3-704.

(a)     The County Board shall meet at least twice each month.

(b)     (1) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THIS
SUBSECTION APPLIES TO THE COUNTY BOARD WHEN IT IS CARRYING OUT AN
EXECUTIVE FUNCTION DESCRIBED UNDER TITLE 10, SUBTITLE 5 OF THE STATE
GOVERNMENT ARTICLE.

(2) Except [for those actions authorized by subsection (c) of this section]
AS PROVIDED IN PARAGRAPH (3) OF THIS SUBSECTION, all actions of the County
Board shall be taken at a public meeting and a record of the meeting and all actions
shall be made public.

[(c)] (3) The County Board may take actions in closed session in accordance
with § 10-508 of the State Government Article[, including action to close a meeting].

Whenever this subtitle and another law that relates to meetings of public bodies
conflict, this subtitle applies unless the other law is more stringent.
