AN ACT concerning

Education - Liability for Education Costs - Exemptions for Out-of-State

Adoption Agencies

FOR the purpose of exempting certain out-of-state agencies that place children in
certain residential care situations from liability for the costs of the education of
those children; and generally relating to exempting out-of-state child
placement agencies from the liability for the costs of certain children's
education.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

4-122.

(e) (1) [Out-of-state] EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, OUT-OF-STATE agencies that place a child in a foster care home or
residential facility in Maryland shall be liable for the costs of [such] THE child's
education, including transportation.

(2) THE PROVISIONS OF PARAGRAPH (1) OF THIS SUBSECTION DO NOT
APPLY TO OUT-OF-STATE AGENCIES THAT PLACE A CHILD FOR ADOPTION AS
DEFINED IN § 5-301(J) OF THE FAMILY LAW ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 2003.
