Ch. 100                                    2003 LAWS OF MARYLAND

7.5-109.

The [wholesaler and the] retail dealer [do] DOES not bear the risk of less and
[are] IS not liable for any product defect, product contamination, or other product or
packaging damage except for damage that [they cause] THE RETAIL DEALER
CAUSES.

SECTION 2. AND BE IT FURTHER ENACTED, That:

(a)     The Office of the Comptroller shall create and provide a list of wholesalers
who are willing to participate in the handling of direct wine shipments,

(b)     The list created under subsection (a) of this section:

(1)     shall be posted on the website for the Office of the Comptroller;

(2)     shall be provided, free-of-charge, to any individual who requests
information regarding direct wine shipments; and

(3)     shall include the name of the wholesaler, a contact person for the
wholesaler, and a contact phone number for the wholesaler,

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 2003.

CHAPTER 100
(Senate Bill 525)

AN ACT concerning

Upper Shore Regional Council

FOR the purpose of adding a new article to the Annotated Code of Maryland to be
designated and known as the Upper Shore Regional Council; establishing the
Council as a regional planning and development agency for Cecil, Kent, and
Queen Anne's counties to facilitate regional planning and development where
the counties are located; providing for the function and dissolution of the
Council; providing for the membership of the Council; providing for the terms of
the members of the Council; prohibiting a member from receiving compensation;
specifying that membership on the Council does not constitute an office of profit;
authorizing the Council to employ a council executive director; providing for
legal representation of the Council; providing for the powers and functions of the
Council; providing funding for the Council from the State budget and local
governments representing the Council and, subject to a certain contingency, the
State budget; providing for the construction of this Act; and generally relating to
the Upper Shore Regional Council.
