(1)     qualify for assistance from the fund during fiscal year 2002 or 2003;

and

(2)     apply for assistance from the fund before July 1, 2003; and

(3)     remain eligible for assistance at the time services are provided.

SECTION 4. AND BE IT FURTHER ENACTED, That the initial performance
audit of the electric universal service program under § 7-512.1(c)(3) of the Public
Utility Companies Article, as enacted by this Act, shall be completed on or before
January 7, 2004.

SECTION 4 5. AND BE IT FURTHER ENACTED, That Sections 1 and 2 1, 2,
and 4 of this Act shall take effect July 1, 2003.

SECTION 5 6. AND BE IT FURTHER ENACTED, That, except as provided in
Section 4 5 of this Act, this Act shall take effect June 30, 2003.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

7-202.

(a)     (1) The Commission consists of [eight] TEN members.

(2) With the approval of the Governor and the advice and consent of the
Senate, the Secretary shall appoint the members of the Commission.
