2-509. POPULATION DATA BASE.

(A)     CREATION BY DIRECTOR.

THE DIRECTOR SHALL CREATE A POPULATION DATA BASE COMPRISED OF DNA
SAMPLES COLLECTED UNDER THIS SUBTITLE.

(B)     REMOVAL OF PERSONAL IDENTIFIERS.

ALL PERSONAL IDENTIFIERS SHALL BE REMOVED BEFORE INFORMATION IS
ENTERED INTO THE POPULATION DATA BASE.

(C)     AVAILABILITY OF INFORMATION.

(1)      NOTHING SHALL PROHIBIT THE SHARING OR DISSEMINATING OF
POPULATION DATA BASE INFORMATION WITH:

(I)      FEDERAL, STATE, OR LOCAL LAW ENFORCEMENT AGENCIES;

(II)     CRIME LABORATORIES THAT HAVE BEEN APPROVED BY THE
DIRECTOR AND THAT SERVE FEDERAL, STATE, AND LOCAL LAW ENFORCEMENT
AGENCIES;

(III)   A STATE'S ATTORNEYS OFFICE; OR

(IV)    A THIRD PARTY THAT THE DIRECTOR CONSIDERS NECESSARY
TO ASSIST THE CRIME LABORATORY WITH STATISTICAL ANALYSES OF THE
POPULATION DATA BASE.

(2)      THE POPULATION DATA BASE MAY BE MADE AVAILABLE TO AND
SEARCHED BY ANY AGENCY THAT PARTICIPATES IN CODIS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 88B, § 12A(m)(4).

The Public Safety Article Review Committee notes, for consideration by the
General Assembly, that subsection (c)(1)(iii) of this section provides for
sharing of information with a State's Attorney's office but not with other
prosecutorial officers such as the U.S. Attorney's office. See, e.g., §
2-508(a)(1)(iii) of this subtitle.
