AN ACT concerning
Private Detective Agencies - Hiring Individuals Not Certified as Private
Detectives
FOR the purpose of providing that an individual who is not certified as a private
detective may provide private detective services in the State if the individual is
employed by or has applied for employment with a licensed private detective
agency, the licensed private detective agency has taken certain steps to have the
individual certified as a private detective, the individual passes a preliminary
investigation, and the Secretary of the State Police has not denied the
application; making this Act an emergency measure; and generally relating to
the hiring of certain uncertified individuals as private detectives by licensed
private detective agencies.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Business Occupations and Professions
13-401.
(A) [An] EXCEPT AS PROVIDED UNDER SUBSECTION (B) OF THIS SECTION, AN
individual shall be certified by the Secretary as a private detective before the
individual personally may provide any private detective service in the State.
(B) AN INDIVIDUAL WHO IS NOT CERTIFIED AS A PRIVATE DETECTIVE MAY
PROVIDE PRIVATE DETECTIVE SERVICES IN THE STATE IF:
(1) THE INDIVIDUAL IS EMPLOYED BY OR HAS APPLIED FOR
EMPLOYMENT WITH A LICENSED PRIVATE DETECTIVE AGENCY;
