SECTION 3. AND BE IT FURTHER ENACTED, That, subject to the provisions
of Section 2 of this Act and for the sole purpose of providing for the referendum
required by Section 2, this Act shall take effect October 1, 2000 July 1, 2000.

(House Bill 1064)
AN ACT concerning
Montgomery County - Board of Education - Public Hearings on
Transportation of Students
FOR the purpose of requiring the Montgomery County Board of Education to hold a
public hearing whenever it meets to take action hears an appeal relating to the
transportation of students bus stops and bus routes; requiring that certain
notice be given of certain hearings; requiring that certain individuals be given
the opportunity to testify and present their views at certain hearings; requiring
that a decision on an appeal be made at a public hearing and that the individual
vote of each member of the board be recorded on the public record; and generally
relating to the Montgomery County Board of Education.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Education
3-903.
(a) All actions of the County Board shall be taken [after] AT a public meeting,
the record of which shall be made public.
(b) This EXCEPT AS PROVIDED IN SUBSECTION (C) OF THIS SECTION. THIS
section does not prohibit the County Board from meeting and deliberating in
executive session provided that all action of the Board, together with the individual
vote of each member, is contained in a public record.
(C) (1) NOTWITHSTANDING SUBSECTION (B) OF THIS SECTION, THE COUNTY
BOARD MUST HOLD A PUBLIC HEARING WHENEVER IT MEETS TO TAKE ACTION
RELATING TO THE TRANSPORTATION OF STUDENTS.
