component of the motorized wheelchair, but does not include a condition or defect that
is the result of abuse, neglect, or unauthorized modification or alteration of the
motorized wheelchair by a consumer. (1) "Reasonable attempt to repair" means any of the following occurring
within the term of an express warranty applicable to a new motorized wheelchair or
within 1 year after first delivery of the motorized wheelchair to a consumer,
whichever is sooner: (1) The same nonconformity with the warranty is subject to repair at
least four times by the manufacturer, motorized wheelchair lessor, or any of the
manufacturer's authorized motorized wheelchair dealers and the nonconformity
continues; or (2) The motorized wheelchair is out of service for an aggregate of at least
30 days because of warranty nonconformities. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
construed only prospectively and may not be applied or interpreted to have any effect
on or application to any sales or transfers of motorized scooters or other motorized
wheeled devices designed to provide mobility assistance for individuals with
disabilities before the effective date of this Act. SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2000. Approved April 25, 2000.
CHAPTER 95
(House Bill 62) AN ACT concerning Anne Arundel County - Multiple Class H Board of License Commissioners - Issuance of Licenses FOR the purpose of authorizing the Anne Arundel County Board of License
Commissioners to issue to holders of certain retail alcoholic beverages licenses a
certain number of additional Class H (beer, wine and liquor) licenses or Class H
(beer and wine) licenses under certain circumstances; authorizing the Board to
issue to persons who do not hold a retail alcoholic beverages license a certain
maximum number of certain licenses under certain conditions; authorizing the
Board of License Commissioners to issue a Class H (beer and wine) license to a
person who independently owns and operates a restaurant that is part of a
common franchise corporate entity under certain conditions; establishing a
certain limitation on the number of additional Class H licenses that the Board
may issue;
requiring the Board of License Commissioners to adopt regulations to
carry out certain provisions of this Act; requiring the Anne Arundel County
Economic Development Corporation in consultation with the Board of License
