(D) THE AUTHORITY IS CONSIDERED TO BE A "NONPROFIT ORGANIZATION",
AS USED IN §§ 402 AND 403 OF TITLE IV OF THE PUBLIC UTILITY REGULATORY
POLICIES ACT OF 1978, P.L. 95-617, CONCERNING SMALL-SCALE HYDROPOWER
PROJECTS. [5-933.] 5-921. The Authority may authorize the executive director of the Authority to approve,
on behalf of the Authority, any financial assistance to be provided from the
[Authorized Purpose Insurance] INDUSTRIAL DEVELOPMENT Fund UNDER § 5-918
OF THIS SUBTITLE which does not exceed, with respect to any one transaction, the
total aggregate amount of $50,000. Any such approval by the executive director shall: (1) Be subject to the concurrence of the Secretary or the chairman of the Authority; (2) Comply with the requirements of this subtitle; and (3) Be binding upon the Authority.
[5-934.] 5-922. The Authority may itself approve the form of any agreement entered into by the
Authority under this subtitle or may authorize the executive director of the Authority
to approve the form of any agreement entered into by the Authority under this
subtitle. Any payment by the Authority under an agreement entered into by the
Authority under this subtitle shall be made at the time and in the manner that the
Authority, in its sole and absolute discretion, determines. [5-935.] 5-923. [Transactions are] FINANCIAL ASSISTANCE AWARDED BY THE AUTHORITY
UNDER THIS SUBTITLE IS: (1) Subject to the provisions of Article 49B; of the Code concerning
discrimination and unlawful practices; and (2) Not subject to the provisions of Title 17, Subtitle 1 of the State
Finance and Procurement Article. [Part V. Premiums and Fees.] [5-936.] 5-924. (a) The Authority may, in its sole and absolute discretion, set the premiums
and fees to be paid to it for providing financial assistance under this subtitle. (b) The premiums and fees set by the Authority shall be payable in the
amounts, at the time and in the manner that the Authority, in its sole and absolute
discretion, requires. (c) The premiums and fees need not be uniform among [transactions]
APPROVALS FOR FINANCIAL ASSISTANCE, and may vary in amount:
