(Senate Bill 151)
AN ACT concerning
Attendant Care Program - Administrative Costs
FOR the purpose of providing that the Attendant Care Program shall be funded as
provided in the State budget; repealing certain provisions that relate to
administrative costs; and generally relating to the Department of Human
Resources and the Attendant Care Program.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 41 - Governor - Executive and Administrative Departments
6-703.
(a) The [Department shall allocate funds for the] Attendant Care Program
[and for administrative costs as provided in this section, in accordance with] SHALL
BE FUNDED AS PROVIDED IN the State budget.
(b) The Department [shall] MAY administer the Program directly or [may]
enter into a contract with a private organization to administer and operate the
Program[, and:
(1) If the Program is administered by the Department, the funds shall be
used as payments for attendant care services and not for administrative costs; or
(2) If the Department enters into a contract with a private organization,
the private organization may use the funds as payments for attendant care services
and for reasonable administrative costs. The administrative costs allowed under the
contract shall be negotiated and approved by the Director.
(c) The Department shall limit expenditures for payments for attendant care
services, and for administrative costs as provided in this section, to the total amount
of funds provided for the Program in the State budget].
