(2) By written order, the Commissioner may allow further operation of
the dental plan organization if the Commissioner finds that it is in the best interest of
enrollees and that enrollees will be afforded the greatest practical opportunity, to
obtain continuing dental plan coverage. (E) INSTEAD OF OR IN ADDITION TO SUSPENDING OR REVOKING A
CERTIFICATE OF AUTHORITY, THE COMMISSIONER MAY: (1) IMPOSE ON THE HOLDER A PENALTY OF NOT LESS THAN $1,000 BUT
NOT EXCEEDING $50,000 FOR EACH VIOLATION OF THIS SUBTITLE; AND (2) REQUIRE THE HOLDER TO MAKE RESTITUTION TO ANY PERSON WHO
HAS SUFFERED FINANCIAL INJURY BECAUSE OF A VIOLATION OF THIS SUBTITLE. [(e)] (F) (1) Notwithstanding subsections (c) [and], (d), AND (E) of this
section, a dental plan organization that has had its certificate of authority suspended
or revoked, HAS BEEN ORDERED TO PAY A PENALTY OR MAKE RESTITUTION, or has
suffered an adverse decision by the Commissioner is entitled to a hearing under §
2-210 of this article. (2) Hearings and appeals from orders of the Commissioner are governed
by §§ 2-203 and 2-210 through 2-215 of this article. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2000.

Annapolis MD 21401 Dear Mr. Speaker: In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 106 - State Personnel - Organ Donation Leave. This bill provides that a State employee may request up to seven days of organ
donation leave in any 12-month period to serve as a bone marrow donor and up to 30
days of organ donation leave in any 12-month period to serve as an organ donor. This
bill applies to all employees, including temporary employees, of all units in the
executive, judicial, and legislative branches of State government, including any unit
with an independent personnel system. The employee may use organ donation leave
only after providing prior medical documentation of the proposed donation and
obtaining approval from the employee's appointing authority. Senate Bill 17, which was passed by the General Assembly and signed by me on May
11, 2000, accomplishes the same purpose. Therefore, it is not necessary for me to sign
House Bill 106. Sincerely,
