DRAFTER'S NOTE: This section is derived without substantive change from
former § 7.01(a)(1) and (b) of this subheading.
Former § 7.01(a)(2) is transferred without substantive change to § 14.02 of
this article.

subheading.

7.02, CIVIL PENALTY FOR ZONING VIOLATION.
[(1)] (A) (1) In this [subsection] SECTION, the following words have
the meanings indicated.
[(i)] (2) "Commission" means the planning and zoning commission
or A similar body of [the] A county.
[(ii)] (3) "Local legislative body" means;
[1.] (I) [The elected body of a county, whether known as] A
BOARD OF county [commissioners, or county council; and] COMMISSIONERS;
(II) A COUNTY COUNCIL; OR
[2.] (III) The Mayor and City Council of Baltimore.
[(hi)] (4) "Zoning official" means a county employee with the duty of
enforcing the zoning ordinance.
[(2)] (B) [The] A local legislative body OF A COUNTY may provide a civil
penalty for a zoning violation, which shall be enforced as provided in this
[subsection] SECTION.
[(3)] (C) (1) [The] A zoning official may deliver a citation to a person
believed to be committing a civil zoning violation.
(2) (I) [A] THE ZONING OFFICIAL SHALL KEEP A copy of the citation
[shall be retained by the zoning official and].
(II) THE CITATION shall bear a certification attesting to the truth of
the matters set forth IN THE CITATION.
(3) The citation shall contain:
(i) The name and address of the person charged;
(ii) The nature of the violation;
(iii) The [place where] LOCATION and time [that] OF the violation

(iv) The amount of the fine [assessed];
