(D) " PORTS OF MARYLAND" INCLUDES THE PORT OF BALTIMORE, ANNAPOLIS,
PINEY POINT, COVE POINT, AND CAMBRIDGE.
(E) " PROVIDE DOCKING SERVICES" MEANS:
(1) TO PILOT A VESSEL WHEN THE VESSEL IS UNDERWAY WITH TUG
ASSISTANCE IN ANY OF THE PORTS OF MARYLAND;
(2) (1) TO MANEUVER A VESSEL DURING BERTHING OR UNBERTH1NG
OPERATIONS WITH TUG ASSISTANCE: OR
(3) (2) WHILE ABOARD THE VESSEL, TO SHIFT A VESSEL WITHIN A
PORT, WITH TUG ASSISTANCE.
5.5-102.
ANY VESSEL USING TUG ASSISTANCE IN THE PORTS OF MARYLAND,
REGARDLESS OF THE WEIGHT OF THE VESSEL OR WHETHER THE VESSEL IS DRIVEN
BY MOTOR, STEAM, OR SAIL, SHALL EMPLOY A DOCKING MASTER LICENSED UNDER
THIS TITLE TO PROVIDE DOCKING SERVICES. NOTWITHSTANDING ANY OTHER
PROVISION OF THIS TITLE, A PERSON LICENSED BY THE BOARD OF PILOTS TO PILOT
VESSELS OF UNLIMITED DRAFT SHALL BE AUTHORIZED TO:
(1) MANEUVER A VESSEL DURING A BERTHING OR UNBERTHING
OPERATION WITH TUG ASSISTANCE; OR
(2) SHIFT A VESSEL WITHIN A PORT WITH TUG ASSISTANCE.
SUBTITLE 2. STATE BOARD OF DOCKING MASTERS.
5.5-201.
THERE IS A STATE BOARD OF DOCKING MASTERS IN THE DEPARTMENT.
5.5-202.
(A) (1) THE BOARD CONSISTS OF 7 5 MEMBERS.
(2) OF THE 7 MEMBERS OF THE BOARD.
(I) 2 SHALL BE LICENSED DOCKING MASTERS;
(II) 1 SHALL BE A MEMBER OF THE MARITIME INDUSTRY;
(III) 1 SHALL BE A MEMBER OF THE STEAMSHIP INDUSTRY WHO
ACTIVELY PROCURES THE SERVICES OF A LICENSED DOCKING MASTER;
(IV) (II) 1 SHALL BE A REPRESENTATIVE OF A TOWING BOAT
COMPANY SERVING THE PORT OF BALTIMORE; AND
(V) (III) 2 SHALL BE CONSUMER MEMBERS.
(3) THE GOVERNOR SHALL APPOINT EACH MEMBER WITH THE ADVICE
OF THE SECRETARY AND THE ADVICE AND CONSENT OF THE SENATE.
