(26) Is professionally incompetent; (27) Practices registered nursing or licensed practical nursing without a
license before obtaining or renewing a license, including any period when the license
or a temporary license of the applicant or licensee has lapsed; (28) After failing to renew a license or after a temporary license has
lapsed, commits any act that would be grounds for disciplinary action under this
section; (29) Practices registered nursing or licensed practical nursing on a
nonrenewed license for a period of 16 months or longer; (30) Violates regulations adopted by the Board; (31) Performs an act that is beyond the licensee's knowledge and skills; (32) When acting in a supervisory position, directs another nurse to
perform an act that is beyond the nurse's knowledge and skills; or (33) When acting in a supervisory position, directs another nurse to
delegate a nursing task to an individual when that nurse reasonably believes: (i) The individual lacks the knowledge and skills to perform the task; or (ii) The patient's condition does not allow delegation of the nursing task. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2000. Approved May 11, 2000.
CHAPTER 452
(House Bill 1051) AN ACT concerning State Board of Nursing - Nursing Assistants in the Rehabilitation Program FOR the purpose of adding nursing assistants to the health professionals who may
participate in the rehabilitation program of the State Board of Nursing;
authorizing the Rehabilitation Committee to review and designate treatment
facilities and services for nursing assistants; authorizing the Rehabilitation
Committee to determine if a nursing assistant may safely continue to practice;
requiring the Rehabilitation Committee to prepare certain reports and
rehabilitation programs for participants; requiring the Rehabilitation
Committee to make certain reports to the Board; requiring the Board to keep all
nursing assistant rehabilitation records confidential; authorizing the Board to
