(f) (D Notwithstanding [the provisions of subsection (a)] § 5.05(A) of this
[section] ARTICLE, [in St. Mary's County] the [county commissioners] COUNTY
COMMISSIONERS may provide a civil penalty for a subdivision violation. (2) In a proceeding before the district court, [the] A subdivision violation
shall be enforced in the same manner and to the same extent as [set forth for] A
municipal [infractions in] INFRACTION UNDER Article 23A, § 3(b) of the Code. (g) (1) Notwithstanding [the provisions of subsection (c)] § 7.02 of this
[section] ARTICLE, [in St. Mary's County] the County Commissioners may provide a
civil penalty for a zoning violation. (2) In a proceeding before the District Court, [the] A zoning violation
shall be enforced in the same manner and to the same extent as [set forth for] A
municipal [infractions in] INFRACTION UNDER Article 23A, § 3(b) of the Code. DRAFTER'S NOTE: Subsection (a) of this section is new language added to
define the scope of the section. Subsections (b), (c), (f), and (g) of this section are transferred without
substantive change from former §§ 4.01(c)(1) and (2), 5.05(d), and 7.01(d) of
this article. Subsection (d) of this section is derived without substantive change from
former § 4.07(b-l) of this article, as that provision related to St. Mary's
County. Subsection (e) of this section is derived without substantive change from
former § 5.05(b) of this article, as that provision related to St. Mary's
County. 14.08. WASHINGTON COUNTY. [(1)](A) [This subsection applies to Charles County and Washington
County.] THIS SECTION APPLIES TO WASHINGTON COUNTY. [(2)] (B) The local legislative body may authorize the planning director
or other designee to grant administrative adjustments from height, setback, bulk,
parking, loading, dimensional, area, or similar requirements of the zoning ordinance. [(3)] (C) The local legislative body [shall consult] SHALL: (1) CONSULT with the planning commission and the board of appeals in
developing criteria and procedures for administrative adjustments under this
subsection[.]; AND [(4)] (2) [The local legislative body shall adopt] ADOPT the criteria and
procedures after reasonable public notice, public hearing, and AN opportunity for
review and comment by the public. [(5)] (D) Criteria for administrative adjustments shall include: [(i)] (1) Standards for actions on requests;
