2000 LAWS OF MARYLAND
(m) [Nothing in this section may be construed to] THIS SECTION DOES NOT
require the adoption of an ordinance by a governing body or [to] authorize a
governing body to require a party to enter into an agreement. DRAFTER'S NOTE: Throughout this section, the defined term "local
jurisdiction" is substituted for the former references to "jurisdiction" for
consistency throughout the article. In subsection (j)(2) of this section, the defined term "local jurisdiction" is
substituted for the former reference to "local government" for consistency
throughout the article. MISCELLANEOUS LOCAL PROVISIONS 14.01. ALLEGANY COUNTY. [The following counties are excepted from the provisions of subsection (a) to the
extent provided in this subsection:] (A) THIS SECTION APPLIES TO ALLEGANY COUNTY. (B) [In Allegany County, the] THE PLANNING commission may consist of
seven members. (C) (1) The term of each member [shall be five years] IS 5 YEARS. (2) EACH MEMBER SHALL SERVE [or] until [his] A successor [takes
office, except that the respective terms of the sixth and seventh members first
appointed may be less than five years] IS APPOINTED AND QUALIFIES. (3) THE TERMS OF TWO OF THE MEMBERS OF THE PLANNING
COMMISSION SHALL BE STAGGERED. DRAFTER'S NOTE: This section is transferred from former § 3.02(b)(1) of this
article. Subsection (a) of this section is new language added to define the scope of
this section. Subsection (c)(3) of this section is derived from the former second clause of
subsection (c)(2) of this section, which is otherwise obsolete. 14.02. BALTIMORE COUNTY. (A) THIS SECTION APPLIES TO BALTIMORE COUNTY. (B) In addition to the jurisdiction [as defined in subsection (c) of this section]
GRANTED IN § 7.02 OF THIS ARTICLE, the legislative body of Baltimore County may
provide by ordinance for an administrative proceeding to enforce its zoning
[regulations, including the imposition of] REGULATIONS. (C) THE ORDINANCE MAY INCLUDE THE AUTHORITY TO IMPOSE civil fines
and penalties for zoning violations.
