(iv) Each [county and municipal corporation] LOCAL JURISDICTION
that creates a HISTORIC DISTRICT COMMISSION OR HISTORIC PRESERVATION
commission under this subtitle shall establish and publicly adopt criteria for
qualifying as a member OF THE COMMISSION [under this paragraph]. (3) (I) [The members] EACH MEMBER OF A HISTORIC DISTRICT
COMMISSION OR HISTORIC PRESERVATION COMMISSION shall be appointed for A
3-YEAR [terms of three years each except that in making the initial appointments
some appointments shall be established for less than three years in order that as
these initial terms expire all subsequent appointments shall be for three years and
shall not expire at the same time] TERM. (II) THE TERMS OF THE MEMBERS OF THE COMMISSION SHALL BE STAGGERED. [(4)] (III) [Members of any] A MEMBER OF A HISTORIC DISTRICT
COMMISSION OR HISTORIC PRESERVATION commission [are] IS eligible for
reappointment. [(5)] (IV) [Any] THE APPOINTING AUTHORITY SHALL FILL ANY vacancy
on a commission [shall be filled by the appointing authority] for the unexpired term
of the [particular] VACANT position. [(6)] (4) Subject to any requirements of [a county or municipal
corporation] THE LOCAL JURISDICTION governing the acceptance and use of gifts by
public officials, [the] A HISTORIC DISTRICT COMMISSION OR HISTORIC
PRESERVATION commission shall have the right to accept and use gifts [for the
exercise of its functions] AS NEEDED TO PERFORM ITS DUTIES. (b) (1) The Maryland Historical Trust may be designated by [the] A
HISTORIC DISTRICT COMMISSION OR HISTORIC PRESERVATION commission to [make
an analysis of] ANALYZE and [recommendation] MAKE RECOMMENDATIONS
concerning the preservation of sites, structures, or districts of historic, archeological,
architectural, or cultural significance within the area served by the commission. (2) [Such report] THE RECOMMENDATIONS OF THE MARYLAND
HISTORIC TRUST may [include proposed] INCLUDE: (I) PROPOSED boundaries [of] FOR sites, structures, or [districts
as well as make recommendations for the) DISTRICTS; AND (II) THE identification and designation of particular sites,
structures, or districts to be preserved. DRAFTER'S NOTE: In subsection (a) of this section, the defined term "local
jurisdiction" is substituted for the former references to "county or a
municipal corporation" and "county or municipal corporation" for
consistency throughout the article.
