Ch. 426
General Provisions 7.01. Enforcement and remedies. (a) (1) The local legislative body may provide by ordinance for the
enforcement of this article and of any ordinance ENACTED or regulation [made
thereunder] ADOPTED UNDER THIS ARTICLE. (2) A violation of this article or of [such] AN ordinance or regulation
ADOPTED UNDER THIS ARTICLE is a misdemeanor[, and such]. (3) THE local legislative body [may provide for] MAY: (I) PROVIDE FOR punishment OF A VIOLATION by fine or
imprisonment or both[. It is also empowered to provide]; AND (II) IMPOSE civil penalties for [such] A violation. (b) (1) [In case any building or structure is erected, constructed,
reconstructed, altered, repaired, converted, or maintained, or any building, structure,
sign, or land is used in violation of this article or of any ordinance or other regulations
made under authority conferred hereby, the proper local authorities of the jurisdiction
in] IN addition to ANY other AVAILABLE remedies, A LOCAL JURISDICTION may
institute any appropriate action or proceeding [to prevent] TO: (I) PREVENT the unlawful erection, construction, reconstruction,
alteration, repair, conversion, maintenance, or use[,] OF A BUILDING, STRUCTURE,
SIGN, OR LAND IN VIOLATION OF THIS ARTICLE OR OF ANY ORDINANCE ENACTED OR
REGULATION ADOPTED UNDER THIS ARTICLE [to restrain]; (II) RESTRAIN, correct, or abate the [violation, to prevent] VIOLATION; (III) PREVENT the occupancy of the building, structure, or [land, or
to prevent] LAND; OR (IV) PREVENT any illegal act, conduct, business, or use in or about the premises. (2) [ However, despite any provisions] NOTWITHSTANDING SUBSECTION
(A) of this section, the [proper local authorities] LOCAL JURISDICTION may not
institute [any] AN action or proceeding [to abate] TO: (I) ABATE a transfer [which] THAT has been [completed or to
prevent] COMPLETED; OR (II) PREVENT the occupancy of a building, structure, or land
involved in the transfer as a result of a violation of § 5.05 or § 5.06 of this article. (3) [Further provided, that any) ANY property subdivided in violation of
§§ 5.05 and 5.06 of this article shall remain subject to the adopted subdivision
regulations.
