Ch. 426 2000 LAWS OF MARYLAND
4.06. Hearing examiners. (a) (1) [The] A local legislative body may appoint [such] THE [full] FULL-
and part-time hearing examiners [as in its discretion may be deemed) THAT IT
CONSIDERS necessary and [appropriate and] APPROPRIATE. (2) (I) A LOCAL LEGISLATIVE BODY may delegate to [the said] A
hearing examiner [or examiners] the power to [hold and] conduct A public [hearings
as required and set forth in] HEARING UNDER § 4.05 [above] OF THIS SUBTITLE. (II) [Such] A hearing shall be conducted [in such a manner and
subject to such] UNDER rules and regulations [as may be provided] ADOPTED by the
local legislative body. (b) [The hearing examiner or examiners shall be appointed for such terms of
office, possessed of such qualifications, and shall receive such compensation as may
be provided by the local legislative body] A LOCAL LEGISLATIVE BODY SHALL
DETERMINE THE TERM OF OFFICE, REQUIRED QUALIFICATIONS, AND
COMPENSATION OF A HEARING EXAMINER EMPLOYED BY THE LOCAL JURISDICTION. (c) [The] A hearing examiner shall render a written recommendation [at
such] IN THE time, MANNER, and [in such manner and] form [as may be] required
by the local legislative body. DRAFTER'S NOTE: In subsection (a)(2) of this section, the former reference to
"hold" is deleted as included within the reference to "conduct". 4.07. Board of appeals. (a) (1) [The] EACH local legislative body shall provide for the appointment
of a board of appeals. (2) [The] Aboard of appeals consists of EITHER three or five members. (3) The terms of office of the members of [the] A board OF APPEALS are
[three] 3 years. (4) [The members of the] A MEMBER OF A board OF APPEALS shall be
appointed by the local executive[,] and confirmed by the local legislative body. (5) A member of [the] A board OF APPEALS may be [removed for cause,
upon written charges, and after] REMOVED: (I) FOR CAUSE; (II) ON WRITTEN CHARGES; AND (III) AFTER a public hearing. (6) [Vacancies shall be filled for] THE APPOINTING AUTHORITY SHALL
APPOINT A NEW MEMBER TO FILL the unexpired [terms] TERM of any member
[whose term becomes vacant] WHO LEAVES A. BOARD OF APPEALS.
