401 of the Internal Revenue Act. If a favorable determination letter is received,
Section 3 of this Act shall take effect the first day of the month after the State
Retirement Agency receives the letter. If the State Retirement Agency does not
receive a favorable determination letter, Section 3 of this Act, with no further action
required by the General Assembly, shall be null and void and of no further force and
effect. The State Retirement Agency, within 5 days after receiving the determination
letter from the Internal Revenue Service, shall forward a copy of the ruling to the
Department of Legislative Services, 90 State Circle, Annapolis, Maryland 21401.
SECTION 7. AND BE IT FURTHER ENACTED, That Section 4 of this Act shall
be construed retroactively and shall be applied to and interpreted to affect all transfers
to the Law Enforcement Officers' Pension System from the Employees' Retirement
System or the Employees' Pension System on or after July 1, 1996.
SECTION 6. 8. AND BE FURTHER ENACTED, That, subject to the provisions
of Section 6 6 above, this Act shall take effect July 1, 2000.

(House Bill 421)
AN ACT concerning
Employees' and Teachers' Pension Systems - Contributory Pension Benefit
FOR the purpose of providing that on the return of accumulated contributions of
certain former members of the Employees' Pension System or the Teachers*
Pension System who are entitled to certain contributory pension benefits, the
former members are not entitled to further benefits on account of membership
in the systems, except under certain circumstances; providing for membership
in the Employees' Pension System or the Teachers' Pension System to continue
for a certain period of time after separation from employment under certain
circumstances; providing for certain members of the Employees' Pension System
or the Teachers' Pension System to receive eligibility service credit for certain
prior service under certain circumstances; requiring certain members of the
Employees' Pension System or the Teachers' Pension System to redeposit certain
withdrawn member contributions plus interest or receive a certain reduction in
the member's retirement allowance; providing for the purchase of service credit
in the Employees' Pension System or the Teachers' Pension System under
certain circumstances; providing for technical changes to provisions of law
relating to disability retirement and cost-of-living adjustments; and generally
relating to the contributory pension benefit under the Employees' Pension
System and the Teachers' Pension System.
