(vi) Any other factor relevant and appropriate to economic
development.
[(b)](D) During the course of evaluating potential qualified Brownfields sites,
the Department shall consult with:
(1) The Department of the Environment, the Office of Planning, and
relevant local officials;
(2) The neighboring community and any citizens groups located in the
community;
(3) Representatives of State and local environmental organizations; (4) Public health experts; and (5) Any other person the Department considers appropriate. [(c)](E) The Department shall develop a program of financial incentives,
including low-interest loans and grants, to assist persons who participate in the
Brownfields Revitalization Incentive Program.
[(d)](E) This section does not affect, and may not be construed as affecting [, the]:
(1) THE planning and zoning authority of a county or municipal
corporation; OR
(2) ANY PROVISION OF THE ENVIRONMENT ARTICLE. SECTION 2. 4. AND BE IT FURTHER ENACTED, That any money received by
the Brownfields Revitalization Fund from a taxing jurisdiction shall only be used for
Brownfields sites in the taxing jurisdictions that have enacted a Brownfields property
tax credit ordinance on or before June 1, 2000. SECTION 5. AND BE IT FURTHER ENACTED, That Section 3 of this Act shall
take effect October 1, 2000, contingent on the taking effect of Chapter 305 (S.B.
783/H.B. 972) of the Acts of the General Assembly of 2000, and if Chapter 305 does not
become effective, Section 3 of this Act shall be null and void without the necessity of
further action by the General Assembly. If Chapter 305 (S.B. 783/H.B. 972) of the Acts
of the General Assembly of 2000 takes effect. Section 1 of this Act shall be null and void
without the necessity of further action by the General Assembly.
SECTION 2. 3. 6. AND BE IT FURTHER ENACTED, That, subject to Section 5
of this Act,
this Act shall take effect October 1, 2000.
