2000 LAWS OF MARYLAND
(F) (H) THE OVERSIGHT COMMITTEE SHALL REVIEW THE REPORTS OF THE
OFFICE OF HEALTH CARE QUALITY AND THE DEPUTY SECRETARY OF HEALTH CARE
FINANCING AND DEVELOP RECOMMENDATIONS TO CONTINUE IMPROVEMENT IN
NURSING HOME CARE. (I) THE OVERSIGHT COMMITTEE SHALL REPORT ITS FINDINGS AND
RECOMMENDATIONS TO THE GOVERNOR AND, SUBJECT TO § 2-1246 OF THE STATE
GOVERNMENT ARTICLE, TO THE GENERAL ASSEMBLY ON OR BEFORE DECEMBER 1
OF EACH YEAR (G) (J) THE DEPARTMENT OF AGING, WITH ASSISTANCE FROM THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE AND THE DEPARTMENT OF
LEGISLATIVE SERVICES, SHALL PROVIDE STAFF SUPPORT FOR THE OVERSIGHT
COMMITTEE. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2000. It shall remain effective for a period of 5 years and 3 months and, at
the end of December 31, 2005, with no further action required by the General
Assembly, this Act shall be abrogated and of no further force and effect. Approved May 11, 2000.
CHAPTER 217
(House Bill 747) AN ACT concerning Nursing Homes - Quality Assurance FOR the purpose of requiring a nursing home, as a condition of licensure by a certain
date, to establish and implement a quality assurance program that meets
certain requirements and is approved by the Department of Health and Mental
Hygiene; requiring a nursing home to employ a quality assurance nurse
designate a qualified individual to manage and monitor the quality of care in
the nursing home and a medical director; requiring the designation of a medical
director; requiring a nursing home to establish a Quality Assurance Committee
that must review and approve annually a quality assurance plan; defining
certain terms; requiring the Secretary of Health and Mental Hygiene, in
consultation with certain entities, to define the role of the medical director for a
nursing home; prohibiting the Secretary of Health and Mental Hygiene from
requiring the disclosure of certain records and reports; authorizing the
Department of Health and Mental Hygiene to impose certain sanctions under
certain circumstances: requiring each nursing home to display certain notice:
requiring the Secretary of Health and Mental Hygiene to adopt regulations that
will provide for medical staff accountability;
requiring the Secretary of Health
and Mental Hygiene to create a technical assistance unit; authorizing the
Secretary of Health and Mental Hygiene to partially reimburse a nursing home
for installing certain automated health systems; authorizing the Secretary of
